The online store www.stoneandcloud.com (hereafter the Website) is governed by the terms and conditions set forth herein, which Customer agrees to comply with. Stone & Cloud may at any time change all or part of the terms and conditions.

GENERAL CONDITIONS

The Terms and Conditions apply when you buy any products from Stone & Cloud. Please read them carefully and make sure you understand them before ordering from our site. Please note that before placing an order you will be asked to agree to these terms. If you do not accept these terms, we won’t be able to process your order.

The Terms and Conditions are subject to change, please look at the top of this page to see when these terms were last updated. Every time you order products from us, the terms in force at the time of your order will apply.

PRODUCT AND PRICES

All offered products are made by Stone & Cloud or their partners. Despite our best efforts, it is possible the actual product differ from the one pictures on the image. It may be the case when the product is manually produced, and the deviations are the result of unique and unrepeatable manufacturing. Although we have made every effort to reflect product colours as accurately as possible, we are unable to guarantee that your computer’s display of the colours accurately reflects the true colour of the products. Due to the type of computer used, colour settings, browser or other settings, the colours of the displayed images may differ from actual colours. Stone & Cloud can not be held liable for such differences.

The prices indicated on the Website are in Euros and include VAT at the statutory rate in force at the time of purchase, plus the respective shipping costs.

The prices and specifications of the products presented on this Website may be altered by Stone & Cloud without prior notice.

PLACING AN ORDER

The possibility of placing orders in the online store on the Website is restricted to orders whose delivery and billing addresses are one of the following:

Andorra, Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Monaco, Netherlands, Poland, Portugal, Romania, Spain, San Marino, Slovakia, Slovenia, Sweden, Vatican.

Orders for delivery to PO Boxes will not be accepted.

If you you wish to place an order and reside outside the European Union, please contact us at welcome@stoneandcloud.com. You should be aware that the customs services in your country may charge you additional customs duties. These rates are not the responsibility of Stone & Cloud and vary by country.

The products shown in the online catalogue are limited to existing stock. In case any item is unavailable, our team at Stone & Cloud will inform you as soon as possible. For some products, duly identified, the order may be limited to a certain number of copies.

The customer may cancel the order, provided that it has not yet been processed by Stone & Cloud. The cancellation of the order may be formalized by an email sent to the address care@stoneandcloud.com. If you exercise a right to cancel your order but the products have already been dispatched, please follow the Returns Procedure set out below Returns and Exchanges.

PAYMENT

We do our best to make your shopping experience as convenient as possible, on our Website you can pay for your order using PayPal, Stripe or a Credit Card in a fast and secure way and without sharing any financial information with the Stone & Cloud Website. For more information on PayPal or Stripe please revise your local PayPal or Stripe website.

Payment for the products and all applicable delivery charges will be taken at the time of ordering.

DELIVERY AND SHIPPING COSTS

Shipping costs are variable according to the destination, weight, dimensions and total volume of the order and will always be calculated before the order is finalised. Shipments are made through DHL, and the shipping time varies depending on the country of destination. In case the same order includes items subject to different delivery periods, the delivery period for the whole order will be that of the item with the longest delivery period.

Please consider that due to COVID-19, the delivery dates might be expanded.

The customer may return the product within 14 days of receiving it. Our team will coordinate with the Customer how to proceed with the return of the goods, contact us under care@stoneandcloud.com, please include your order number into the correspondence.

The product must be in perfect condition and with the original packaging, and must be accompanied by the corresponding invoice. Stone & Cloud reserves the right to not accept returns of products without prior notice, as mentioned above, and which do not meet the same conditions of conformity as they did on the date of their delivery to the Customer (namely products that have undergone any use, transformation, damage and/or are missing the original packaging/accessories/extras).

The customized or monogramed products are excluded from the return.

We emphasize that the cost of sending the returned product and sending the new product must be borne by the Customer.

EXCHANGES AND RETURNS

We make every effort to ensure that the information presented is free of typographical errors and whenever they occur, we proceed with their correction as soon as possible. In case the information provided does not match the characteristics of the product, you have the right to return it in accordance with our Exchanges and Returns policy.

The photographs presented on the site are merely illustrative. We recommend that you consult the product characteristics for detailed information. In case of doubt, please contact our team.

Despite our best efforts, it is possible that some of the products on our site may be incorrectly priced. If we discover an error in the price of the products you have ordered we will contact you to let you know. You then have the option of continuing with the purchase at the correct price or to cancel the order. We will not process your order until we have your instructions. If we haven’t been able to contact you using the details you provided during the order process, then we will treat the order as cancelled and let you know in writing.

GIFT CARDS

Stone & Cloud gift card can be bought and spent in our online store.

You can buy a digital gift card from us by following the instructions on the website and once your payment has cleared, the digital gift card will be sent to the recipient’s email address that you set out in your order. The recipient will be responsible for its safekeeping and proper use. From time to time digital gift card can get caught up in spam filters, and the recipient should make sure they check these filters.

We cannot be held responsible for any digital gift card which is emailed to an incorrect address that you supplied, or which is lost, stolen or deleted. We also cannot take responsibility for digital gift card that cannot be delivered to the recipient’s email address because of spam filters, firewalls or other security measures operating on their system, capacity of their mailbox or any other factors outside our control.

The value of any purchases will be deducted from the value on the gift card, any remaining balance can be used before expiry for future purchases. The gift card cannot be redeemed or exchanged for cash or vouchers.

All refunds/exchanges of goods purchased with the S&C gift card will be made in accordance with our Returns Policy.

INTELLECTUAL AND INDUSTRIAL PROPERTY

All texts and images reproduced or represented on www.stoneandcloud.com are the exclusive property of Stone & Cloudand strictly reserved thereto.

Any reproduction in whole or in part of the site www.stoneandcloud.com or all or part of the elements included in it is strictly prohibited.

Trade names, trademarks or distinctive symbols reproduced in the www.stoneandcloud.com site are protected under the laws applicable to industrial property. The reproduction or representation of all or part of any distinctive symbol is strictly forbidden.

PROTECTION OF PERSONAL DATA

We take your privacy seriously.

When registering to use this website, we will ask you to create a password. You should keep it strictly confidential, not revealing nor sharing it with third parties. The Customer is entirely and exclusively responsible for the use of his/her password and any orders placed by using it, even without his/her knowledge.

In the case of registered Customers, we will collect the information required to carry out the whole sales transaction online and for future contacts that may be necessary so as to ensure the best customer service.

The Customer assures that the personal data provided is true and accurate and undertakes to notify any changes. Any loss or damage caused to the online store or a third party resulting from incorrect inaccurate or incomplete information on the registration forms will be the sole responsibility of the Customer.

The services provided by Stone & Cloud will always honour the provisions of the Personal Data Protection Law – Law no. 58/2019 of August the 8th, therefore, the sole purpose of Stone & Cloud regarding the Customer’s personal data is the customer’s account management, billing, communication with customers and statistical analysis, assuming the commitment to privacy and security in the processing of personal data of each customer.

APPLICABLE LAW AND JURISDICTION

These Terms and Conditions for online shopping in the www.stoneandcloud.com site are governed by Portuguese legislation. The parties agree that any dispute arising from the interpretation and/or application of these Terms and Conditions, whose amicable settlement is not reached, will be submitted exclusively to the jurisdiction of the courts of the headquarters of Stone & Cloud, with express waiver to any other.

By using the online store, the Customer accepts and agrees with these Terms and Conditions and the Privacy Policy and Personal Data Protection.
